1.1 References to “Pacific Airshow” in these Terms and Conditions includes Pacific Airshow Pty Ltd ACN 647 800 539, Code Four Media Group, Inc. (US) and any related entities (as defined pursuant to the Corporations Act 2001 (Cth)).

1.2 Access and use of this website is subject to these Terms and Conditions (Terms). By accessing or using this website, you agree to be bound by these Terms (as amended from time to time) which constitute a contract between you and Pacific Airshow.

1.3 Please read these Terms and all policies including the Privacy Policy carefully before using the Pacific Airshow website. These policies are incorporated into these Terms by reference.

1.4 Pacific Airshow may amend these Terms without notice and you should regularly check these Terms so that you are aware of any amendments. Such amendments will be effective immediately upon publication on the website. Use of this website after any amendments constitutes your acceptance of the Terms as amended.

2.2 Pacific Airshow uses reasonable efforts to ensure the accuracy of the Pacific Airshow material on this website. Pacific Airshow does not review the accuracy of information provided by other parties or information contained in websites linked to this site. Pacific Airshow does not represent that the material on this website is error-free and does not warrant it is accurate, complete, appropriate, reliable or timely. Pacific Airshow also makes no representation or warranty that your access to and use of the Pacific Airshow website will be uninterrupted, secure, error-free, free of viruses or unauthorised code or other harmful components.

5. Suspension of the Website

5.1 Pacific Airshow may from time to time without notice suspend the Pacific Airshow website or disconnect or deny you access to the website during any technical failure, modification or maintenance involved in the website.  Pacific Airshow will use its reasonable endeavours to procure the resumption of the website as soon as reasonably practicable.

6. Cookies

6.1 A cookie is a feature stored on your computer’s hard drive by your web browser.  Pacific Airshow may use cookies to gather data in relation to this website and learn about your preferences and the way you use this website, to improve the website.  Most browsers accept cookies automatically, but you may also be able to disable cookies on your web browser.

11.1 If a provision of these Terms would otherwise be illegal, void or unenforceable or impose an obligation or liability that is prohibited by law, the provision (or relevant part) is to be read down to the extent necessary to be enforceable or to comply with the law whilst still substantially reflecting the intentions as apparent from these Terms.

12. Waiver

12.1 The non-exercise of or delay in exercising any power or right of a party does not operate as a waiver of that power or right, nor does any single exercise of a power or right preclude any other or further exercise of it or the exercise of any other power or right.  A power or right may only be waived in writing, signed by the party to be bound by the waiver.

13. Governing law

13.1 These Terms are governed by the laws of New South Wales, Australia and you submit to the non-exclusive jurisdiction of courts exercising jurisdiction in New South Wales.

Event conditions of entry

When entering the Pacific Airshow event (Event), you agree to abide by the following additional terms and conditions as well the website Terms and Conditions, Privacy Policy and Ticket Policy:

  1. Pacific Airshow (as Event Organiser) reserves the right to refuse entry at its sole discretion.

  2. All patrons attending an Event must hold a valid ticket for the Event. Late arrivals the Event may result in non-admittance until a suitable break in the performance.

  3. At all times, you must comply with all terms and conditions stated on the entry ticket.

  4. Upon entering the Event venue, you agree to undergo a search of person and possessions, including bags, being undertaken at time between entry, exit and whilst inside the Event venue.

  5. You agree to comply with all signs, instructions and directions of police, security personnel and Event staff.

  6. You agree to not bring any of the following prohibited items into the Event venue:

(a) alcohol;
(b) glass receptacles;
(c) illegal substances;
(d) fireworks, sparklers or explosives;
(e) weapons including but not limited to firearms, bombs, grenades, toys resembling firearms. ammunition, brass knuckles, loose batteries, wires, box cutters, mace, tear-gas, pepper spray or knives;
(f) items which may obstruct the view of others or cause a public nuisance (including but not limited to large umbrellas, tents, viewing platforms, megaphones, air horns, sirens, whistles, helium balloons, kites, drones, laser pointers etc);
(g) items, which may be used to create, segregate or reserve viewing areas (including but not limited to rope, poles, temporary fencing or tarpaulins);
(h) any other item(s) that are not listed above and which the Event Organiser deems at its sole discretion a prohibited item.

7. Alcoholic beverages must not be taken into or out of the Event venue. 

8. No animals allowed (except for accredited assistance animals).

9. The Event is a non-smoking event, except in the designated areas.

10. The Event Organiser reserves the right at its sole discretion to add, withdraw or substitute any exhibitors, vendors, performers and/or activities associated with the Event, vary programs, seating arrangements, capacities and to determine and publish additional terms and conditions from time to time as it sees fit.

11. You agree to not engage in any ambush marketing, including with respect to apparel and merchandise that conflicts with Event sponsors or which are unauthorised by the Event Organiser. Such items may be confiscated at any time by the Event Organiser at its absolute discretion.

12. You may be removed from the Event at any time, if the Event Organiser reasonably suspects that you are involved in any unsatisfactory and/or illegal conduct, which is at the sole discretion of the Event Organiser.

13. Any imagery or sound recordings taken by patrons must be for private or domestic purposes only. Any form of commercial exploitation, publication, public display or distribution is prohibited and the Event Organiser may commence legal action in the event of any such breach.

14. You may be filmed and photographed at the Event and you acknowledge and agree that any imagery of you/patrons at this Event may be recorded and reproduced in various commercial formats. By entering the Event venue, you acknowledge and agree that the Event Organiser has exclusive ownership and control of all such recorded imagery and you relinquish any rights or entitlements to ownership or compensation for the commercial use and reproduction of such imagery whatsoever by the Event Organiser.

15. Your entry to the Event venue is entirely at your own risk.

16. You release and indemnify the Event Organiser and its associated entities from any loss, damage, claim, demand or otherwise whatsoever arising out of any loss or damage to property arising out of your attendance at the Event, including where such loss or damage is caused or contributed by the negligence of the Event Organiser or its associated entities.

17. You release and indemnify the Event Organiser and its associated entities from any loss, damage, claim, demand or otherwise whatsoever arising out of any injury or death arising out of your attendance at the Event, including where such loss or damage is caused or contributed by the negligence of the Event Organiser or its associated entities.

18. If any item in these Conditions of Entry is unenforceable, illegal or void then it is to be severed and the rest of the Conditions Entry remain in force.

19. You acknowledge and agree that pass outs will be provided for the duration of the Event.

20. Patrons must not wear or display commercial, political, religious or offensive signage or logos, sell any goods or services or give away political, religious, advertising or promotional materials without the prior written approval of the Event Organiser.

21. Patrons who are, in the opinion of the Event Organiser, offensively attired or whose attire may cause a hazard or compromise safety may also be refused entry into the Event.
